Terms of Service

1. Agreement

By using the Site or placing an order you agree to these terms, our Privacy Policy, Shipping Policy and Return Policy. You must be at least 18, or have a parent or guardian’s permission, to place an order.

2. Orders

Your order is an offer to buy. We accept it when we confirm it by email. We may refuse or cancel an order — for example, if an item is unavailable, a price was shown in error, the payment looks fraudulent, or the artwork breaks Section 3 — and we refund anything you paid for an order we cancel.

Custom orders go into production quickly. If you need to change or cancel one, email sales@nycfactoryinc.com right away with your order number; we’ll do our best, but once printing has started we can’t change or cancel it.

3. Your artwork

You keep ownership of the artwork, photos, logos and text you upload or create (“Artwork”). You give us permission to store, resize, print, embroider and otherwise use your Artwork only to make your order, show you mockups and keep our order records.

You confirm that you own your Artwork or have every right needed to have it printed, and that it doesn’t infringe anyone’s copyright, trademark or other rights. You are responsible for your Artwork and agree to cover our costs if someone makes a claim against us because of it. We don’t print:

• characters, logos, team or brand names, album art, celebrity images or other people’s photos you don’t have permission to use;
• counterfeit goods, or designs meant to be confused with another brand;
• content that is illegal, hateful, threatening, sexually explicit, or that targets minors.

We may refuse or cancel an order that breaks these rules. We print what you send: please check spelling, placement and image quality in the preview before you order. Low-resolution files may print soft or pixelated. If a file can’t be printed well, we may contact you before we print.

Copyright or trademark complaints: email sales@nycfactoryinc.com with a description of your work or mark, where it appears, your contact details, a statement that you believe in good faith the use isn’t authorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner, and your signature.

4. Production, colors and sizing

Every custom piece is made to order in our North Bergen, NJ factory. Colors on screens differ from ink and thread on fabric, and colors can vary slightly between garments, dye lots and print methods. Garments have normal manufacturing tolerances in measurements and print placement. Please check the size chart before ordering. These normal variations are not defects.

5. Prices and payment

Prices are in U.S. dollars and can change at any time; the price you pay is the one shown at checkout. Bulk discounts and discount codes apply as shown at checkout and can’t be combined unless we say so. Sales tax is added where required. Payment is taken by Stripe when you place the order.

6. Shipping

Shipping options and prices are shown at checkout. Delivery estimates are not guarantees — once a package is handed to the carrier, delays are outside our control. Please make sure your shipping address is correct; we are not responsible for packages sent to an address entered incorrectly. Title and risk of loss pass to you when the package is handed to the carrier. See our Shipping Policy.

7. Returns and damaged items

All sales are final. Because custom items are made just for you, we do not accept returns, exchanges or refunds for change of mind or wrong size. If you receive a damaged or defective item, contact us within 7 days of delivery with your order number and photos, and we will make it right with an exchange (subject to availability). 8. Our content

The Site, its design, text, photos, logos and the NYC Factory name belong to NYC Factory Inc. or its licensors. You may not copy or use them without our written permission. Please don’t misuse the Site — no scraping, hacking, automated orders or attempts to disrupt it.

9. Disclaimers

We make every order with care. Apart from what these terms and our Return Policy promise, the Site and our products are provided “as is”, and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the extent the law allows.

10. Limitation of liability

To the fullest extent the law allows, NYC Factory is not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from the Site or your order. Our total liability for any claim is limited to the amount you paid for the order the claim is about. Nothing here limits rights you have that the law does not allow us to limit.

11. Governing law and disputes

These terms are governed by the laws of the State of New Jersey. Before filing a claim, please contact us at sales@nycfactoryinc.com and give us 30 days to resolve it. Any dispute that isn’t resolved will be brought in the state or federal courts in Hudson County, New Jersey.

12. General

We may update these terms; the version on this page with its effective date applies to orders placed after that date. If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a right right away, we don’t give it up.
